A senior hotel manager won his unfair dismissal claim after being fired by SX for being in a hotel room with junior colleagues. The Employment Tribunal ruled in his favor, citing a lack of clear policies regarding workplace relations. The court held that although the manager’s actions were inappropriate, the hotel’s policy did not explicitly prohibit consent relations between colleagues. Sebastian Kedracki was fired after a party with the woman “being red-handed” at the end of her shift. I heard that a colleague found them “dance” around the office, and then they went to a bar and returned to a luxurious room in the club dormitory hotel. The court heard that a guest lived in a building in Covent Garden at about 3 a.m. and complained that she could hear “loud music” and that her husband could not fall asleep. The colleague used the master key to enter the room and found the couple in bed. The senior employee was suspended for the incident and faced disciplinary proceedings, resulting in his dismissal. He brought the hotel to a employment court claiming a “witch hunt” against him, and his claim to unfair dismissal was upheld due to the fault in the investigation. However, the judge ruled that Mr. Jidraghi should not receive any compensation because his boss was the right to fire him. The court in central London was told that Mr. Gidraghi began working in 2013 at the club dormitory hotel in Covent Garden. During the Coovid pandemic, he often stayed in hotels, including 18 months when he had no other accommodation. However, this stopped in September 2021, and guests staying in the hotel picked up again after a pause due to the pandemic. In May 2021, he was promoted to senior guest experience manager. The group heard that there was a problem between Mr. Jidraghi and one of his managers because he refused to wear a blazer, which was part of his uniform. I heard that Mr. Jidrachi found it too hot to wear clothes. He issued a formal warning about “continuous disruption of hotel policies” and “bad team leaders”, which is related to his failure to challenge colleagues who don’t wear masks. The team heard that Mr. Jidraghi faced further disciplinary action in the incident on 29 December 2022. It was heard that Mr. Keidlaki had been “drinking and reveling” with a junior female colleague in his office. I heard that they later stayed in Room 115 for one night without permission and played very loud music, which disturbed the guests between 3 a.m. and 4 a.m. Mr. Jidraki was suspended for the incident on January 17, 2023 and investigated. Witnesses of the incident said he played music from the backstage at 11:30 p.m. and commented that it sounded like “a disco club, maximum amount”. He said he went to talk to Mr. Kedracki, who the woman told them that the music was too big but the door was locked. I heard that the woman could be seen dancing, the lights were turned off, and there were several bottles of alcohol around. He said that at around 3:40 a.m., the guest in another room complained that she could hear very loud music, which meant her husband couldn’t fall asleep. Another colleague was reportedly sent to investigate and said that when he walked into the room he said he could hear “very loud music like a disco” and opened the door and found Mr. Kedracki with the woman in the shower. The employee who sent him was shocked because he thought they were both home. Another staff member entered the room and talked to them and said that when he entered the room, they had SX. He heard that he was pounding it with energy before opening the door, but they didn’t hear it. A female colleague who spent the night with Mr. Kedracki was also interviewed. She said she had seen Mr. Jidraghi late for work in the office and tried to help him. The woman said he should have pulled a bottle out of his schoolbag when he went to find a friend later. She described the difficulties with rail service and said she was working hard to drive a taxi, so they went to a local bar to have a drink. The woman said she asked if she could stay in the hotel and she was “will be embarrassed to find herself in this situation”. Mr. Jidraghi accused his bosses of conducting “demon hunting based on insufficient evidence”. Recalling the incident, he said he “does not remember” what happened, but rather “wake up in his lingerie.” On February 9, 2023, he was fired. He appealed the decision, claiming there was no “reliable evidence” that he held parties and drank alcohol. However, this was dismissed. Employment Judge Timothy Adkin insisted on Mr. Kedracki’s claim of unfair dismissal for procedural reasons. This is because he heard that they did not follow the guidance, but used the same employees as investigators and discipline officers. He also said the appeal was seen by people who had previously been involved in the matter, so there was no “fresh independent eyes” and no “open minds”, but EJ Adkin ruled that hotel workers should be reduced by 100%. The judge said Mr. Jidraki had issued a warning at the time of the incident and therefore should be “extra care to avoid trouble”. EJ Adkin said: “Based on evidence, we considered his actions as a senior employee of the hotel from December 29 to 30, 2022, which constituted abuse and breach of trust because of his management responsibilities and without permission to obtain a hotel facility, playing loud music and having a strong party with junior employees. “He caused inconvenience to other guests and had colleagues perform night shifts in an embarrassing and awkward position. “He was not complaining or really apologizing like he did during the investigation.
