    Supreme Court dismisses case against Mustafa

    Kudirat Abiola murder case: Supreme Court dismisses case against Mustafa

    The Supreme Court on Thursday dismissed the trial of Major Hamza Al-Mustapha (rtd) in connection with the murder of Alhaja Kudirat Abiola, the wife of the famous winner of the 1993 presidential election.

    Mrs Abiola was murdered in Lagos state during nationwide protests that followed the annulment of her husband’s presidential election victory.

    Major Al-Mustapha (rtd), who was the chief security officer (CSO) of the late military head of state, General Sani Abacha, is accused of killing her.

    He was subsequently charged to court by the Lagos State government, along with Latif Shawolahan, the son of the late military dictator Mohammed Abacha.

    The defendant was arraigned on two charges bordering on conspiracy to commit murder and the murder of the late Mrs. Abiola on June 4, 1996.

    Judge Moji Dada of the Lagos State High Court delivered the verdict on January 30, 2012, finding the defendants guilty and sentenced them to death by hanging.

    However, a three-judge panel of the Court of Appeal unanimously decided on July 12, 2013 that the High Court’s judgment was invalid.

    The Court of Appeal also found the defendant not guilty on the premise that the prosecution failed to provide sufficient evidence to support conviction and the death penalty.
