The Special Crime Court in Lagos has refused to stop hearing allegations of corruption against the former governor of the Central Bank of Nigeria (CBN).

Justice Rahman Oshodi dismissed the request for him to withdraw from the trial in his ruling Wednesday, February 26, and pointed out that the defendant’s allegations of bias against him were not confirmed.

Justice Osadi mentioned the 2013 ruling by Nigeria’s current Chief Justice, Judge Kudirat Kekere-Ekun, that “judicial bias is often not sufficient to justify the justification for a judge to reject a case.

To justify disqualification or withdrawal, judges’ biases must usually be personal, or based on certain extrajudicial reasons. ”

Justice Ossadi went on to invoke other judicial precedents from the Supreme Court and later ruled that his application for review lacked merit.

“The application of the prohibition principle to the situation in this case has not yet been confirmed for the allegations of prejudice …. Therefore, the application for review by the first and second defendants was denied. This is the court’s ruling.”

On Monday’s last work, Emefiele filed a verbal application through its chief attorney, Olalekan Ojo (SAN) and his co-defendant’s attorney, Kazeem Gbadamosi (San), urging the court to withdraw from the lawsuit. The basis of bias.

The lawyer argued that by rulings allowed the prosecutor’s attorney to raise a major issue to his witness, a question that the defense had previously opposed, the judge made it impossible for the defense to cross-examine the witness.

Prosecuting attorney Rotimi Oyedepo (SAN) opposed the application and pointed out that they were unwise.

Justice Ossadi also approved Emefiele’s request for permission to demand a court decision on January 8, which challenged the court’s jurisdiction to hear its case.

The judge adjourned the trial until May 26.
