
Justice Rahman Oshodi of the Ikeja Court of Special Offences and Domestic Violence has sentenced Kolawole Muyiwa, a former part-time lecturer at the Adeniran Ogunsanya School of Education (now the University of Education at Lagos State University) to life imprisonment for R@PE.
The crime was committed on October 11, 2021 in the location of Otto-Ijanikin, Lagos State.
Kolawole was arraigned on October 6, 2023 and pleaded not guilty. However, when the verdict was made, Justice Ossodi found him guilty, citing detailed testimony from the survivor and the defendant’s confession of establishing a relationship with her, which he claimed was platonic.
“Kolawole Muyiwa, I find you guilty of R@PE, in violation of the 17th Criminal Code of Lagos State University Volume 17 Law of 2015. I noticed that you are a first-time offender with no criminal record, you are married and have three children. You are also a part-time lecturer. However, the gravity of the crime committed cannot be ignored: “As a part-time lecturer, you occupy a position of trust and authority over abuse.
The victim is a student of the institution you teach.
“Section 260 of the Criminal Code describes the life imprisonment for your crime, and that’s what I will sentence you to. You should also be registered as a sex offender.”
During the trial, the survivor told the court that on October 11, 2021, she arrived at a department meeting at 10 a.m. early. She said while waiting outside the classroom, the defendant approached and asked her to go and give him a meal.
The court noted that the survivor followed the defendant to get the flask to buy food and he took her to the office.
“When they entered the room, the defendant said he no longer wanted food and needed help to mark some test scripts. She added that the defendant walked outside and returned and locked the access door and the door to the office.”
She said the defendant asked her if she had a boyfriend, and she said no.
He suddenly pushed me off the plastic chair I was sitting on, overwhelmed me, and took off my pants hard. I was menstruating and he removed my sanitary pad and had strong sex with me.
The survivor said the defendant said after using the S3X with her: “You refuse what you want to give me, I do my best.”
The defendant told the court in his account that on October 11, 2021, he came to the university to record and submit the script and encountered a door with the survivor who was willing to help him carry his schoolbag.
He asked if she could help her agree to the record score.
The defendant told the court that he asked the survivors to establish a relationship within the office, which she accepted. He explained that the relationship was casual.
“Together, talk, be relevant to each other, not for sexual relations.”
He then denied the R@Ping survivor.
His lawyer, Dr. Go Erenta, told the court that because the survivor’s evidence was fictional, there was no certain evidence.
But the judge believes that the survivor’s testimony was confirmed with the testimony of legal practitioners and IPOs.
