
A California delivery driver agreed to negligence in the location of carelessness in handling hot hot tea in the jury.
Michael Garcia sued the cafe chain after sending out tea on the legs of a delivery bus and permanently disfigured his penis.
His attorney Nick Rowley said in a press release that the accident happened to Garcia’s “life”.
“There is no money to eliminate the permanent catastrophic injury he suffered, but the jury verdict is a crucial step in getting Starbucks to blatantly ignore the safety of its clients and not take responsibility,” Rowley said.
Starbucks said it planned to appeal, adding that it “has been committed to the highest safety standards in our stores.”
“We sympathize with Mr. Garcia, but we disagree with the jury’s decision that we are negligent in the incident and believe that the compensation is too much,” Starbucks said in a statement.
According to his attorney, Garcia arrived in Starbucks in Los Angeles on February 8, 2020 to pick up three Venti “Medicine Ball” teas, when he was a postal delivery driver. He was handed to a cardboard carrier and the drink was performed on the express train when the cup fell directly into his leg and the top popped out of one of the drinks.
Video provided by Rowley shows Starbucks employees preparing drinks and tea spilling to Garcia’s knees.
Garcia’s lawyer argued in court that the window employees failed to properly secure the drink in the carrier.
Garcia suffered a third-degree burn on her penis, groin and inner thighs.
Raleigh’s company says Garcia has two skin grafts on Grossman Burn Center’s penis, and any friction on the area will cause Garcia’s pain.
