Inyang Inyang Edem Ekwo of the Federal High Court of Abuja denied the request of the National Democratic Party Secretary (PDP), Senator Samuel Anyanwu to prevent the Independent National Election Commission (INEC) from enforcing his removal as a party for dismissal.
Instead, the judge directed Anyanwu to notify INEC and other defendants in the new lawsuit to allow his views to be considered.
Naija News Understand that Anyanwu filed a former application to the Federal High Court forbidden INEC or its representative from accepting or signing any letter or written order under the PDP unless he signed it.
In an application filed by his attorney Kco Njemanze (San), Anyanwu also asked Judge Ekwo to prevent Ambassador Umar Illiya Damagun from sending any letters, documents or written comments to INEC unless they sign their signature.
After considering the plaintiff’s argument, Justice Ekwo admitted in a brief ruling that an urgent case had been identified based on Anyanwu’s claim.
However, the judge refused to pass the former party application to approve the plaintiff’s request, and instead chose to hear from the defendant before giving any order.
Therefore, he directed Anyanwu to inform INEC and Damagun about the new lawsuit to ensure they have a chance to appear in court and make arguments.
Judge Ekwo directed the plaintiff to provide the necessary court documents to the two defendants and a trial is scheduled to be heard on February 24.
