The federal high court in Abuja dismissed the lawsuit filed by Chief Brown Menee and two other National Election Commissions (INECs) seeking to restrict independence in order not to release new reports on election wards and poll units in northern Worri north Worri, northern Worri and western Worri west local government areas.
Judge Nwite declared the ruling that the case constituted an attempt to challenge the Supreme Court’s ruling and described it as a “judicial breakdown.”
The court further ruled that the lawsuit was filed three months outside the law, and subsequently dismissed the lawsuit.
The Supreme Court has ordered INEC to give a new description of election wards and voting units in the Federal District of Warri. INEC conducted field surveys and visited communities and settlements throughout the constituency.
However, before the Commission released its findings, members of Itsekiri ethnic group sought interim orders from the Federal High Court in Abuja to prevent INEC from enforcing the Supreme Court’s directive.

INEC, represented by SAN’s Suleiman Ibrahim, believes that the Federal High Court lacks jurisdiction because the matter has been determined by the Supreme Court.
Justice Nwite upheld INEC’s argument, pointing out that a reexamination of the Supreme Court’s ruling would be a judicial decision. With this ruling, INEC can now implement a new description report as directed by the Supreme Court.
