However, Judge Dashin believes that Article 137(3) of the Constitution does not prohibit Jonathan from competing for the 2023 presidential election because the provision cannot be retroactively applied. The judge ruled that Jonathan’s oath made on May 6, 2010, following the death of President Yar’adua, complyed with the constitution, not because he participated in the competition and won the election.
He noted that the 2007 election produced the late Musa Yar’adua as president, not Jonathan, adding that Article 137(3) could not have retroactive effects to prevent him from competing with the 2023 presidential election. The judge believes that Section 137(3), which came into effect on June 8, 2018, “cannot apply retroactively unless the legislature explicitly states that their intentions are.” Lawyers have disagreements over Jonathan’s qualifications, while the country’s senior lawyer yesterday believed that former President Goodluck Jonathan was eligible for the 2027 presidential election. Their intervention was after the PDP move, which was considered to award the automatic vote to the former president if he returned to the party and became politically active again. However, in view of the fourth change to the 1999 Constitution, the above decision of the PDP questioned Jonathan’s legal position again for the presidency, which prohibited anyone from accepting the presidential oath twice after the election.
