The Federal High Court in Abuja has set up on April 10, 2025 to demand a lawsuit to remove Deputy Admiral Ibokette Ibas (RTD) from the sole administrator of Rivers State.
The case filed by legal practitioner Johnmary Jideobi challenges the constitutionality of Ibas’ appointment, believing it undermines Nigeria’s constitutional framework.
The legal lawsuit lists President Bra Tinub as the first defendants, calling on the court to announce the appointment of Ibas and suspend the governor and lieutenant governor of Rivers State as unconstitutional, null and void.
The case, tagged FHC/ABJ/CS/572/2025, involves several defendants, including the federal attorney general and the attorney general of all 36 states.
In the lawsuit, the plaintiff argued that the president had no constitutional power to suspend or remove his office in order to maintain the term of office of elected officials, citing part of the 1999 Constitution.
Jideobi argued in his affidavit that the Constitution did not support the position of establishing the sole executive of the River State and appointed the IBA deputy admiral to the post.
He pointed out that there was no provision for sole executive in the 1999 Constitution, and such appointments violated federal principles and separation of powers.
The plaintiff also asked the court to announce a statement that only specific constitutions, such as those outlined in Articles 180, 188, 189 and 306, would allow the removal or interruption of the term of office of the elected governor.
Jideobi further requested the court to issue an order prohibiting President Tinob from appointing sole executives in any state and asserting that such appointments are unconstitutional and unstable.
The plaintiff stressed that the president’s actions could set dangerous precedents, leading to the formal election of Nigeria as governor and deputy governor arbitrarily dismissed.
The plaintiff also stressed the public interest of the case, emphasizing the need for judicial intervention to protect the integrity of Nigeria’s constitutional democracy.
