
Today on February 28, the Supreme Court resumed its ruling prohibiting the central bank of Nigeria, CBN and federal accountants from allocating the statutory monthly to Rivers State.
The Supreme Court further ordered honors. Martins Amaewhule led the River State Capitol and other elected House members to immediately resume sitting without hindrance.
The court accused the Court of Appeal’s Abuja Division of evacuating the initial order that prevented Governor Siminalaye Fubara from refusing to reintroduce the 2024 Appropriations Act before HON, thus preventing the release of funds from the consolidated income to River State. The River State Capitol led by Martins Amaewhule.
It held that contrary to the appeals court ruling, the federal high court in Abuja had the necessary jurisdiction to enjoy the lawsuit, which was brought by 27 legislators led by Amaewhule to challenge the ongoing evacuation and expenditure of the state without the approval of the state parliament.
A five-member panel, made by Justice Emmanuel Agim, ruled in its main judgment that the Court of Appeal misunderstood the core issue when it fixed it only on the consolidated revenues in Rivers State.
“This false view affects its view that the subject is not within the powers of the Federal High Court,” the Supreme Court noted. He stressed that the center of the case was the denial of Governor Fobara to a compliance with a court order requiring him to propose an authorization bill to an effective parliament.
It agrees with the High Court that the PDP allegedly violated all Progressive Assembly by 27 legislators from the People’s Democratic rebellion, and that the APC remains a valid member of the Rivers Parliament, awaiting finalization of its status.
The Supreme Court rejected Governor Fobara’s claim that in view of the defection of the legislators, he must invoke the necessary doctrine by filing an appropriation bill to the remaining five members of the parliament.
According to the court, the necessary doctrine must be cited to justify illegal actions.
The Supreme Court accused Governor Fubara of destroying the government because he feared being impeached, and the Supreme Court ruled 5 million nnn nnnnn Nibions.
