
The Supreme Court has declared Samuel Anyanwu, a powerful ally of the Federal Capital Territory (FCT), as the Secretary of the People’s Democratic Party (PDP).
Anyanwu and Ude-Okoye on Sunday have been locked in a fierce battle, causing the party’s stakeholders to split.
However, Ude-Okoye received support from different groups of the party, whose actions were based on the decision of the Court of Appeals sitting in Enugu.
The Court of Appeal confirmed the removal of the Federal High Court in Enugu.
But in Friday’s unanimous judgment, a five-member Supreme Court panel said that matters bordering the leaders or members of a political party are their internal affairs and should not be the court’s business.
The Supreme Court said in the main judgment of Judge Jamilu Tukur that the special circumstances in which the court ruled on internal affairs of the political party were lost.
These special circumstances stipulated by the Court are: In the event of a crime or infringement of contractual rights, the Nigerian Constitution grants the court such jurisdiction.
After Anyanwu left for the IMO governoral election, the position of state secretary became a controversial issue.
After the loss of the election, efforts to regain seats for the secretary put the party in crisis.
The Court of Appeals sitting in Enugu insisted on December 20, 2024 that the High Court removed Senator Anyanwu as PDP State Secretary and confirmed Ude-Okoye’s ruling as the real secretary.
However, Anyanwu applied for execution and appeal.
