Federal High Court in Abuja directs senators Respect To bring the Supreme Court ruling, he claimed to restore him to Democratic Democratic State Secretary (PDP) within seven days.
Naija News Justice Inyang Ekwo argued after Anyanwu’s chief attorney, San chief Ken Njamanze, emphasized the Supreme Court’s ruling, he argued that the order determined a conflict of law against the position of PDP’s national secretary.
The directive was a day after the High Court hearing Anyanwu case, trying to stop the execution of the parallel ruling, which had removed him from office and recognized RT. honor. Udeh-Okoye Ememchukwu is the party’s legal state secretary.
It is important to note that the Enugu Court upheld a High Court decision in a ruling last December that dismissed Senator Anyanwu and acknowledged RT. honor. Udeh-Okoye is the party’s state scribe.
The court ruled that with the state secretary violating the PDP’s constitution, Anyanwu’s term violated his competition and won the party’s candidacy in the IMO state governor’s election last year.
In view of the judgment, both the Board of Directors (BOT) and the PDP National Working Committee (NWC) support Udeh-Okoye Chief.
Dissatisfied with these rulings, Anwu called for Supreme CourtND also filed a motion with the High Court to suspend his judgment.
In a unanimous ruling last Friday, a five-member Supreme Court justice repealed the rulings of two lower courts for lack of jurisdiction.
Naija News The report said the Supreme Court ruled that the issues addressed by the lower courts were related to internal affairs of the political party, and that the field claimed that no court had the power to intervene.
The Supreme Court ruling triggered mixed reactions and different reactions were elicited in the camps of Anyanwu and RT. honor. Udeh-Okoye declares victory.
In an affidavit in response to Senator Anyanwu’s claim, Rt. honor. Udeh-Okoye, identified as the fourth defendant, told the court that although the plaintiff was elected at the National Convention on October 30, 2021, he was subsequently nominated as a party candidate for the 2023 governoral election in the 2023 IMO State.
He noted that Article 47(5) of the PDP Constitution requires that any official elected to the Executive Committee at any level resign before he competes for any elective position. In addition, Article 47 (6) allows the appointment of individuals in the same area or region to complete the term of office of a resigned person.
The fourth defendant explained that the PDP board reminded the party’s President Ambassador Umar Damagun in a letter dated October 12, 2023 that the party’s violations were reminded about the parties concerned about constitutional violations.
He noted that the party’s Southeastern executives held a meeting in Enugu on October 16, 2022, during which he was nominated to perform the remaining term of Senator Anyanwu.
RT. honor. Udeh-Okoye further asserted that the legal action led to a simultaneous judgment of the Enugu Court, stemming from the aforementioned meeting where he was nominated.
Therefore, he demanded that the lawsuit be dismissed.
Judge Ekwo arranged the April 28 judgment after all parties made the arguments on Tuesday.
