A convicted teacher who has a £xual relationship with a student will not face imprisonment time but will be sentenced to her sentence for probation.
In November 2024, Shawnee Nicole Despain, 26, admitted to the inappropriate relationship between educators and students because she was revealed to have a £xual relationship with a student.
The 17-year-old student attended Rockdale High School, Texas, where Despain taught agricultural science.
Despain resigned in September 2023 after the investigation revealed an inappropriate relationship. Despain was also found pregnant, and DNA tests showed her husband was not a father.
However, she initially hid her child’s parent-child relationship on her husband until everything exploded.
The modified proof was found on the criminal’s phone, with text messages claiming love, and footage of S£X found on Despain’s Snapchat.
Despain surrendered on November 7, 2023, first accused of child pornography and establishing an inappropriate relationship.
Teacher relationships are often considered second-degree crimes and are eligible for 20 years in prison.
But Magistrate John W. Youngblood replaced the 10-year probation at a sentencing hearing last week. The former teacher confiscated her guilty teaching license for crimes, which does not require her to be registered as a £x criminal.
At the hearing, Milam County District Attorney Brian Price argued that the defendant deserved the imprisonment time. Price states that if the case involves male teachers and female students, the results may vary.
Price commented: “My argument to the judge is that her power and trust in the student is abused by this young man and it will affect his life.
“People should maintain a higher standard of authority and trust, not lower standard.”
