    11 PDP governors have not provided subpoena to AGF Tinubu

    11 The Governor of the People’s Democratic Party (PDP) questioned Rivers Governor Siminalayi Fubara, suspended by President Bola Tinubu, and has not summoned a subpoena in the federal Attorney General (OAGF) and the federal government office.

    Naija News The report said that the PDP governor was also in the announcement of a state of emergency with the president in Rivers State. The attorney general of the federal and federal governments is listed as defendants in the lawsuit.

    However, sources in the OAGF show that the summons have not been delivered to the defendants, preventing them from responding to the allegations raised in the lawsuit.

    A senior OAGF official confirmed this to the country and said: “We have read the lawsuits in the media. You told us in the media that some PDP-controlled states have filed lawsuits against the emergency rules announced by Rivers State. At present, I can confirm to you that the AGF office is not yet served. I think this office will also be with the process designed to serve the federal government or the president. We are waiting. This is our office. If any lawsuit is indeed filed, we will respond accordingly once service is served as needed. ”

    The lawsuit is tagged SC/CV/329/2025 and has been filed by Adamawa, Enugu, Enugu, Osun, Oyo, Bauchi, Akwa Ibom, Plateau, Delta, Delta, Taraba, Taraba, Zamfara, Zamfara and Bayelsa States. The governor is seeking a Supreme Court ruling to determine whether the president has the right to suspend the state structure of democratic elections.

    The plaintiffs also sought to determine whether the president’s way of declaring a state of emergency in the Rivers State violated the 1999 Constitution.

    In particular, the plaintiff asked the Supreme Court to determine the following:

    1. Whether the president can legally suspend or interfere with the offices of the governor and lieutenant governors in any state of Nigeria and replace them with the sole executive who is not elected under the guise of a state of emergency, especially in any plaintiff’s country.

    2. Whether the president can legally suspend any state legislature in Nigeria under the guise of a state of emergency, especially in any plaintiff’s country.

    3. Whether the president threatens to suspend the posts of governors and deputy governors through a state of emergency violates the constitutional provisions, including those related to the federal system and governors.

    Once the necessary legal documents are provided to the federal government and the AGF office, the legal process will proceed.
