    NBA criticizes river administrators for allegedly ignoring the rule of law

    NBA criticizes river administrators for allegedly ignoring the rule of law

    The Nigerian Bar Association (NBA), a Port Harcourt branch, strongly criticized the actions of the only Chief Executive of Rivers, Deputy Admiral Ibok-Ete Ibas, accusing him of violating the Constitution and undermining the democratic government of the state.

    In a press statement issued by the Rivers State Chairman Agency signed by the Chairperson of the 8 branch, the NBA expressed deep concern about the actions taking place under the sole administrative model, which was carried out after a state of emergency was declared.

    Lawyers condemn the structure of interference in constitutional guarantees, including the suspension of the latest appointments of officials from elected states and the sole executive. The NBA describes these actions as illegal, provocative and destructive to democratic institutions. The statement stressed that the actions of the sole executive violated the spirit and constitution of the Constitution of the Federal Republic of Nigeria in 1999 (as amended).

    The NBA stressed that as an institution dedicated to upholding the rule of law, it cannot remain silent when ignoring the constitutional order. It warned that the ongoing situation poses a threat to Nigeria’s democratic system and could erode public trust in governance and legal systems. The statement also raised concerns about harassment and intimidation by citizens, especially those criticizing states of emergency or attempted peaceful protests.

    To make clear calls to President Bola Tinubu, the NBA calls for an immediate review and reversal of the emergency governance framework in Rivers State. It called for the restoration of Governor Siminalayi Fubara and other formally elected officials, and stressed that the people’s mandate should not be ignored. The NBA reiterates that the democratic will of the people is sacred and uneasy and must be respected by all relevant institutions.

    The association ends by reaffirming its commitment to democratic values, constitutionalism and peaceful conflict. It warns that covering the legitimacy of the constitution or normal administrative action could set dangerous precedents for governance throughout Nigeria. The NBA’s strong stance shows that people are resisting civil society and increasing professional institutions, opposing their view as gradual erosion of democratic norms in the country.
