Assistant Commissioner of Police, Drambi Vandi, who allegedly killed a Lagos-based lawyer, Bolanle Raheem, on Christmas Day has asked the Lagos State High Court to sack him because he had no case answer.
Therefore, the Lagos State Government filed a ¥rder case against him under Section 223 of the Lagos State Penal Code, 2015
“ASP Vandi unlawfully killed one Omobolanle Raheem (F) on December 25, 2022 at Ajah Roundabout, Lekki-epe Expressway, Lagos Judicial Branch, by shooting her in the chest part ,” for his part
Vandi pleaded not guilty and a trial has since begun.
When proceedings resumed on Monday, March 6, Judge Iberok Harrison adjourned for final written addresses from prosecution and defense lawyers.
Defense lawyer Adetokunbo Odutola prayed the court to dismiss the suit while adopting Vandi’s final written address in a no-case submission filed on February 28. Odutola argued that the ballistics report presented by prosecutors showed that the gun did not match the bullet used in the shooting.
According to him, the pathologist called on the prosecutor to seek evidence stating that the bullet passed through the armpit from the left side, while the prosecutor stated that the deceased was shot in the chest. He concluded that, relying on these “inconsistencies” and several others, the prosecution did not bring an action against its client requiring him to undertake his defence.
However, the prosecution team, led by the Lagos State Attorney-General, Moyosore Onigbanjo, objected to him, arguing that it had presented prima facie evidence against the accused, making it necessary for him to provide defend.
